Military Justice Administration
Mission
The Military Justice Administration Division oversees all aspects of receiving, tracking and storage of records of trial received from Navy and Marine Corps Commands for review by the Judge Advocate General and the Navy-Marine Corps Court of Criminal Appeals (NMCCA). Code 40 maintains the OJAG central files for court-martial records of trial.
Function
Code 40 maintains a post-trial case tracking system of those records of trial forwarded to the NMCCA for review in accordance with Articles 66, Uniform Code of Military Justice (UCMJ). All records of trial received in Code 40 are reviewed for completeness prior to forwarding for review. Post review, Code 40 is responsible for the promulgation of decisions of the NMCCA to the appellant in accordance with the JAG Manual. Code 40 personnel also tracks cases submitted to the U.S. Court of Appeals of the Armed Forces (USCAAF) under Article 65, UCMJ, and promulgates the actions taken by that court.
Military Justice Information Branch
Responsible for providing public access to court dockets, filings, and records from the Navy-Marine Corps and United States Coast Guard in compliance with Department of the Navy policies and procedures.
Freedom of Information Act Branch
Processes FOIA requests concerning the military justice system and individual courts-martial; and responds to requests for records of trial. Questions concerning military justice FOIA requests may be directed to Code 40 foiamiljus@navy.mil or (202) 685-7064.
Appellate Victim / Victim Witness Assistance Program (VWAP) Branch
Track and notify Navy and Marine Corps victims and witnesses of appellate proceedings and decisions. The DD Form 2703 (dtd Mar 16), informs them of their right to be notified of the status of appellate review, including appellate courtroom hearings and the final decision of any appellate court or judge advocate review. The first notification is when the record of trial is received by Code 40 and continues all the way through until the appeals process is exhausted and the case is closed. Victims and witnesses can opt in or out of appellate notifications at any time, by contacting the Appellate VWAP, Program Manager.
